ApartNest – Accommodation Agreement &Terms of Service

1. THE PARTIES

By completing and paying for this reservation you agreed to this Accommodation Agreement (“Agreement”) is made on the reservation_date between:

Guest: You/booker (“Guest”)

Host: ApartNest, traded by Andorinha Properties Limited, a company registered in Scotland (Company No. SC763738) (“Host”).

 

2. THE PREMISES

The Host agrees to make available the following accommodation to the Guest in exchange for the agreed room rate:

A room(s) in ApartNest ApartHotel, located at 17 High Street, Auchterarder, PH3 1DB

(hereinafter referred to as the “Accommodation”).

 

3. ACCOMMODATION TERM

The Guest is permitted to occupy the Accommodation from:

• Check-in: Checkin Date and Checkin Time

to

• Check-out: Checkout Date at Checkout Time

(“Accommodation Term”).

 

4. END OF AGREEMENT & CHECK-OUT

4.1 The Guest must vacate the Accommodation by the stated check-out time.

4.2 The Host has no obligation to provide accommodation beyond this time.

4.3 Unauthorised late check-outs may incur additional charges.

 

5. UNMANNED APARTHOTEL & GUEST RESPONSIBILITY

5.1 The Guest acknowledges that ApartNest ApartHotel is an unmanned property.

5.2 The Guest agrees to take reasonable care for their own safety and that of others.

5.3 Guests must familiarise themselves with fire evacuation procedures and comply with all health and safety rules.

 

6. MANDATORY ID VERIFICATION (CONDITION OF STAY)

6.1 Government-issued photo ID must be uploaded via the official ApartNest guest portal prior to arrival.

6.2 This is a material condition of the booking and required for security, fraud prevention, insurance, and regulatory compliance.

6.3 Refusal or failure to provide ID constitutes guest non-compliance, not a failure of service by the Host.

 

7. ADVANCE NOTICE & ACCEPTANCE

7.1 ID, check-in, access, and behavioural requirements are provided:

• In writing

• In advance of arrival

• Via the welcome message

• Via the guest portal

• Via this Agreement

7.2 By booking, accessing the portal, or attempting check-in, the Guest confirms informed acceptance of this Agreement.

 

8. DENIAL OF ACCESS ≠ CANCELLATION

8.1 If access is denied due to:

• Refusal to provide ID

• Refusal to complete check-in

• Guest discomfort with data upload

• Refusal to sign or acknowledge this Agreement

• Failure to comply with stated requirements

this does not constitute cancellation or breach by the Host.

8.2 The Accommodation remains available and reserved for the Guest for the full Accommodation Term.

 

9. NO-REFUND POLICY

9.1 The Guest is not entitled to any refund under this Agreement.

9.2 Refunds are at the sole discretion of the Host.

9.3 No refunds will be issued due to:

• Guest non-compliance

• Privacy concerns

• Discomfort with verification

• Platform description discrepancies

• Change of mind

9.4 Refusal to comply does not constitute “services not rendered.”

 

10. BOOKING FEES & PAYMENTS

10.1 The Guest shall pay the full amount as detailed during the booking process.

10.2 Amenities, photos, and descriptions may vary across booking platforms and do not entitle the Guest to a refund.

 

11. OCCUPANCY LIMIT

11.1 Maximum authorised guests are per your room or booking statement.

11.2 Exceeding this limit constitutes a material breach and may result in immediate termination without refund.

 

12. QUIET HOURS & QUIET ENJOYMENT

12.1 Quiet hours are from 10:00pm until sunrise.

12.2 No music or excessive noise is permitted.

12.3 Disturbances, parties, or large gatherings are grounds for immediate termination.

 

13. PARKING

13.1 Parking is limited and first-come, first-served.

13.2 Vehicles must be parked responsibly.

13.3 The Host accepts no liability for vehicle loss or damage.

 

14. SECURITY DEPOSIT

14.1 If applicable, a security deposit may be required.

14.2 It will be returned subject to the Accommodation being vacated in a reasonable condition.

14.3 Deductions may be made from your payment card, without notice, for any damage, cleaning, or repairs discovered during or after your stay.

 

15. PETS, SMOKING & FIRE RISKS

15.1 No pets or animals permitted.

15.2 Smoking and vaping are strictly prohibited, including windows and car park.

15.3 Candles and incense are prohibited.

15.4 Breaches may result in forfeiture of deposit and termination and may result in a further cleaning charge.

 

16. CHILDREN

16.1 Guests must disclose children under six (6) years old.

16.2 Children under six may stay only with explicit Host permission.

16.3 Children must be supervised at all times, especially on staircases.

 

17. HEALTH & FIRE SAFETY

17.1 Guests must comply with all safety signage and rules.

17.2 Fire doors must remain closed.

17.3 In case of fire, evacuate immediately and congregate across the road.

17.4 Malicious fire alarm activation may result in fines or loss of deposit.

 

18. MAINTENANCE & DAMAGE

18.1 The Guest must leave the Accommodation in a fair, ready-to-clean condition.

18.2 Costs for excessive cleaning, repairs, or damage may be charged directly and without notice from your payment card.

18.3 The Host may pursue recovery of costs and notify booking platforms of misconduct.

 

19. INSPECTION & TERMINATION

19.1 The Host may inspect rooms without prior notice.

19.2 Any breach may result in immediate termination without refund.

 

20. USE OF ACCOMMODATION

20.1 The Accommodation is for short-term stay only.

20.2 No commercial activity, subletting, or implied tenancy permitted.

20.3 The address must not be used for correspondence or residency claims.

 

21. ILLEGAL ACTIVITY

21.1 Illegal activity of any kind results in immediate termination with no refund.

 

22. POSSESSIONS LEFT BEHIND

22.1 The Host is not responsible for lost property.

22.2 Items unclaimed after two (2) weeks may be disposed of or retained.

 

23. HOST LIABILITY & INDEMNITY

23.1 Guests indemnify the Host against injury, loss, or damage arising from use of the Accommodation.

23.2 The Guest is responsible for their own travel insurance.

 

24. CHARGEBACKS & PAYMENT DISPUTES

24.1 The Guest agrees not to initiate chargebacks for matters covered by this Agreement.

24.2 The Host may rely on:

• This Agreement

• Portal logs

• ID request records

• Access logs

• Communication records

24.3 Guest non-compliance does not equal failure of service.

 

25. SOLICITORS’ FEES

The Guest agrees to pay all reasonable legal costs incurred enforcing this Agreement.

 

26. GOVERNING LAW

This Agreement is governed by the laws of Scotland.
